professional trustee?
By · CommentsAn attorney is helping us to setup a minor’s trust and a trust needs a trustee. Either a parent or parents can serve as a trustee, or we can hire a professional trustee to manage the minor’s trust.
This is not a normal trust but a minor’s trust resulted from the proceed of an accident settlement. Withdrawals are subject to the court’s approval until the child becomes 18 years of age. Trustee has to provide an anual status report to a a judge. Trustee must be bonded, etc. has duty to invest responsibly, to file federal/state tax, etc. ?

No Capital punishment equals no Justice
Capital punishment is defined as the legal infliction of death as a penalty for violating criminal law. This method has been around for thousands of years executing many criminals. Capital punishment is still needed in today’s society and is still as effective as well. The judicial system is flawed in certain aspects, but the ability to take human life is an important power that it should keep. Without Capital punishment, people will be allowed to kill a human being and still get the opportunity to live their life, even if behind bars. Hammurabi himself once suggested “an eye for an eye; a tooth for a tooth", which was a form of punishment used throughout history. The Bible even talks about the death penalty as an acceptable means of punishment. It states, “Whoever strikes a man so that he dies shall be put to death” (Exodus 21:12).Thomas Hobbes theory serves a valid point in this dilemma. According to Hobbes we must follow a set of laws that revolve around punishments in order for our society to function properly. Proper punishment discourages wrong doers. One may agree the methods of killing people in the past have been inhumane, but overtime we have adjusted and used technology to make the deaths less painful. Do criminals deserve to live their life in prison? One may think not because prison still has some luxuries such as food, recreation time and being able to commerce with friends. The act of breaking the law isn’t as taxing as it would be if the death penalty was a possibility and served as discouragement for some. All states should have the death penalty legalized, because without the proper punishment, criminals may never truly pay for the magnitude of their crime.
Capital punishment has been around for thousands of years. It has been used for public entertainment by the Romans and for punishment by other civilizations. The methods used in ancient times were barbaric and cruel because they wanted the covicted felons to suffer before death.
One might say there are many cons towards capital punishment and that would be correct. If we execute a person, what is the difference between us and the criminal who has committed the horrendous crime of killing the other individual? A protester of capital punishment might also say how mostly poor people end up being executed because they cannot hire a good attorney to defend them which is another true statement, Another con of capital punishment would have to be if the man is innocent and is executed. Even though this hasn’t happened in over 30 years there still might be a chance of this happening in the near future and we cannot bring back a life lost due to our mistake. Finally an opponent might also bring up the fact that the death penalty doesn’t affect criminals in any way. The crime rates increased even as more execution began to happen. “The law which attempts a man’s life is impractical, unjust, and inadmissible. It has never repressed crime — for a second crime is every day committed at the foot of the scaffold”. This is a quote by Bertrand Russell which is saying that the government shouldn’t have the power to take a persons life. Also it says many people commit crimes but they aren’t persecuted for them
Opponents toward the death penalty may say that capital punishment is far more expensive than life in prison that the cost of the death penalty is at least $2 million per case (source). According to the justice department capital punishment cases are actually cheaper than life without parole cases. Nearly 1.2-3.6 million dollars extra is going to be wasted per case if we do not keep the death penalty. The death penalty strikes fear into criminals and mostly everyone fears death. If we give the death penalty time crime will begin to deter. Life imprisonment is less of a deterrent since the criminals knows he has a chance to be sent free. So, in return we must take the lives of murderers in order to protect future victims. One would argue that the death penalty violates the 8th amendment however; the United States has taken protocols toward this by making more humane procedures. Another reason why many civilians dislike the death penalty is there might be a chance the criminal is innocent. A response toward this is that no system is 100% accurate. Just like any other system mistakes will be made. The chance of the person being executed is innocent is small indeed, as a matter of fact since the reintroduction of the death penalty there has been no evidence of an innocent man or women being executed. The United States takes many precautions before executions in order to insure that person is not innocent.
Criminals have such a lack of respect for the government, laws and respect for life it seems the only way to deal with such people is to kill them. One would know putting to death one murderer, kidnapper or thief is not going to stop robberies and murders from happening, but at least there will

Wrong Trustee? Breach of Self Managed Super Fund

QUESTION: When I established my Self Managed Super Fund I recall that being faced with the decision of whether to have a company as trustee or have each member of my fund act as trustee.
I opted for the company as trustee. As a consequence, all assets held in my Super Fund are in the name of the company.
In a recent discussion with my wise accountant, the administration issues and operating costs of my company as trustee were discussed. My accountant suggested that the administration costs of my fund could be reduced if I changed the trustee. He suggested that I remove the company as trustee and replace the trustee with me and my wife.
Fewer administration issues and reduced operation costs – I jumped at the idea to update my trustee. My wife and I assumed the position as trustee and we quickly transferred the funds assets out of the company’s name and into our names. I thought this was all we had to do.
I again recently met up with my accountant and he stated that I had to formerly document the change of trustees. Is this the case? If so, how do you update?
ANSWER: In future, best to speak with your accountant before you do something. You currently have a non-complying fund which the Auditor may need to report to the ATO. Your accountant is correct you need to document by deed the change in trustees. I suggest that today you go to LawCentral www.lawcentral.com.au, and generate the Update Trustees and Members Deed. It takes about 7 minutes and it is quite painless. Next to each question there are free hints if you need help. This short and easy to understand deed:

adds new members
updates trustees
As you will see, the Update Trustees and Members Deed also allows you to document any changes in the members of your fund (so you can update both trustees and members in the same document).
You then can bring the breach to the notice of the Auditor, but with the facts that you have rectified the breach.
